गोपनीयता नीति (प्राइवेसी पॉलिसी)

हमारी गोपनीयता नीति (प्राइवेसी पॉलिसी) में अंतिम बार 11 नवंबर 2022 को बदलाव किया गया था।

यह गोपनीयता नीति (प्राइवेसी पॉलिसी) आपके द्वारा इस सेवा के उपयोग के दौरान आपकी सूचनाओं के संग्रह, उपयोग और उसके खुलासे (डिस्क्लोज़र) से संबंधित हमारी नीतियों और प्रक्रियाओं का वर्णन करती है और आपको आपके गोपनीयता (प्राइवेसी) अधिकारों और कानूनी सुरक्षा के प्रावधानों से अवगत कराती है।

इस सेवा का उपयोग करके, आप इस गोपनीयता नीति के अनुसार अपनी सूचनाओं के संग्रह और उपयोग के लिए सहमत होते हैं।

व्याख्या और परिभाषाएं

1. व्याख्या

जिन शब्दों के प्रारंभिक अक्षर बड़े अक्षरों (कैपिटल लेटर) में हैं, उनके अर्थ निम्नलिखित शर्तों के तहत परिभाषित किए गए हैं। निम्नलिखित परिभाषाओं के अर्थ समान होंगे चाहे वे एकवचन में हों या बहुवचन में।

2. परिभाषाएं

इस गोपनीयता नीति के उद्देश्य के लिएः

• "खाता" का अर्थ है हमारी सेवा या हमारी सेवा के कुछ हिस्सों तक पहुँचने के लिए आपके लिए बनाया गया एक अनूठा खाता।
• "एप्लिकेशन" का अर्थ है कंपनी द्वारा प्रदान किया गया सॉफ़्टवेयर प्रोग्राम जिसे आपने किसी इलेक्ट्रॉनिक उपकरण ( डिवाइस) पर डाउनलोड किया है, जिसका नाम 'जीविका' है
• "कंपनी" (इस अनुबंध में "कंपनी", "हम", "हमें" या "हमारा" के रूप में संदर्भित) सेंटर फॉर सिविल सोसाइटी को संदर्भित करता है
• "देश" भारत को संदर्भित करता है
• "कुकीज़" छोटी फाइलें होती हैं जो किसी वेबसाइट द्वारा आपके कंप्यूटर, मोबाइल उपकरण (डिवाइस) या किसी अन्य उपकरण (डिवाइस) में स्थापित की जाती हैं, जिसके कई उपयोगों में से एक उस वेबसाइट पर आपके ब्राउज़िंग इतिहास का विवरण रखना होता है
• "डिवाइस" का मतलब उन सभी उपकरणों से है जो कंप्यूटर, लैपटॉप, सेल फोन या डिजिटल टैबलेट जैसी सेवा तक पहुंच स्थापित कर सकता है।
• "व्यक्तिगत डेटा" का मतलब वह सूचना है जो किसी पहचाने गए या पहचाने जाने योग्य व्यक्ति से संबंधित है।
• "सेवा"का संदर्भ एप्लिकेशन से है। 
• "सेवा प्रदाता" का अर्थ उस प्राकृतिक या कानूनी व्यक्ति से है जो कंपनी की ओर से डेटा को संसाधित (प्रॉसेस) करता है। यह सेवा को सुविधाजनक बनाने, कंपनी की ओर से सेवा प्रदान करने, सेवा से संबंधित सेवाओं को उपलब्ध कराने या सेवा का उपयोग करने के तरीके का विश्लेषण करने में कंपनी की सहायता करने के लिए कंपनी द्वारा नियोजित तृतीय-पक्ष (थर्ड पार्टी) कंपनियों या व्यक्तियों को संदर्भित करता है।
• "प्रयुक्त (यूसेज़) डेटा" सेवा के उपयोग या स्वतः सेवा के बुनियादी ढांचे से एकत्र किए गए या उत्पन्न किए गए डेटा को संदर्भित करता है (उदाहरण के लिए, पृष्ठ दर्शन (पेज विज़िट) की अवधि)।
• “आप” का अर्थ उस व्यक्ति से है जो इस सेवा, या कंपनी तक पहुंच रहा है या उसका उपयोग कर रहा है, या उस व्यक्ति से है जो किसी अन्य वैध संस्था की तरफ से इस सेवा तक पहुंच रहा है या उपयोग कर रहा है, जो भी लागू हो।  

आपके व्यक्तिगत (पर्सनल) डेटा को एकत्र करना और उसका उपयोग करना

एकत्रित किए  जाने वाले डेटा के प्रकार

1. निजी (पर्सनल) डेटा

हमारी सेवा का उपयोग करते समय, हम आपसे कुछ व्यक्तिगत डेटा प्रदान करने के लिए कह सकते हैं जिसका उपयोग आपसे संपर्क करने या आपकी पहचान करने या हमारी सेवाओं के माध्यम से आपको सहायता प्रदान करने  के लिए किया जा सकता है। व्यक्तिगत डेटा में निम्नलिखित चीजें शामिल हो सकती हैं, लेकिन यह इन तक ही सीमित नहीं है:

• ईमेल पता (एड्रेस)
• नाम (फर्स्ट नेम) और उपनाम (लास्ट नेम) 
• आयु
• फोन नंबर 
• पता, राज्य, प्रांत, डाक (ज़िप/ पोस्टल) कोड, शहर,  स्थान (लोकेशन)
• व्यवसाय का नाम 
• व्यवसाय का पता (राज्य, प्रांत, डाक (ज़िप/ पोस्टल) कोड, शहर, स्थान (लोकेशन)
• प्रयुक्त (यूसेज़) डेटा
• चित्र (फोटो)  
• ध्वनि अभिलेख (वायस रिकॉर्डिंग)  
• वीडियो  
• पहचान वाले दस्तावेज (डॉक्युमेंट्स) जैसे कि आधार कार्ड, विक्रय प्रमाण पत्र (वेंडिंग सर्टिफिकेट) और अनुशंसा पत्र (रिकमेंडेशन लेटर) 

2. प्रयुक्त (यूसेज़) डेटा

सेवा के प्रयोग के दौरान स्वतः एकत्रित किए जाने वाले प्रयुक्त (यूसेज़) डेटा

प्रयुक्त (यूसेज़) डेटा में आपके उपकरण (डिवाइस) का इंटरनेट प्रोटोकॉल पता (जैसे आईपी पता), ब्राउज़र का प्रकार, ब्राउज़र का संस्करण (वर्ज़न), हमारी सेवा के माध्यम से उपलब्ध कराए गए पृष्ठ जो आप देखते (विजिट करते) हैं, आपके द्वारा पृष्ठ देखने (विजिट करने) का समय और तारीख, उन पृष्ठों पर बिताया गया समय, विशिष्ट उपकरण का पहचानकर्ता (यूनिक डिवाइस आइडेंटिफायर्स) और अन्य नैदानिक (डायग्नोस्टिक) डेटा जैसी सूचनाएं शामिल हो सकती है।

जब आप किसी मोबाइल उपकरण (डिवाइस) द्वारा या उसके माध्यम से सेवा का उपयोग करते हैं, तो हम स्वचालित रूप से (ऑटोमेटकली) कुछ सूचनाएं एकत्र कर सकते हैं, जिसमें आपके द्वारा उपयोग किए जाने वाले मोबाइल उपकरण (डिवाइस) का प्रकार, आपके मोबाइल उपकरण (डिवाइस) की विशिष्ट आईडी, आपके मोबाइल उपकरण (डिवाइस) का आईपी पता, आपके मोबाइल का ऑपरेटिंग सिस्टम, आपके द्वारा उपयोग किए जाने वाले मोबाइल इंटरनेट ब्राउज़र का प्रकार, विशिष्ट उपकरण पहचानकर्ता (यूनिक डिवाइस आइडेंटिफायर्स) और अन्य नैदानिक (डायग्नोस्टिक) डेटा सहित अन्य सूचनाएं शामिल  हैं।

आप जब भी हमारी सेवा प्राप्त करते हैं या जब आप किसी मोबाइल उपकरण (डिवाइस) के द्वारा या उसके माध्यम से हमारी सेवा हासिल करते हैं तो हम उन सूचनाओं को भी एकत्र कर सकते हैं जो आपके ब्राउज़र द्वारा हमें भेजी जाती है।

3. एप्लिकेशन का उपयोग करते समय एकत्र की जाने वाली सूचनाएं 

हमारे एप्लिकेशन का उपयोग करते समय, हमारे एप्लिकेशन की सुविधाएं  (फीचर्स)  प्रदान करने के लिए, कुछ सूचनाएं हम आपकी पूर्व अनुमति से एकत्र कर सकते हैं:

• आपके स्थान (लोकेशन) से संबंधित सूचनाएं 

हम इस जानकारी का उपयोग अपनी सेवा से संबंधित सुविधाएं (फीचर्स) प्रदान करने, अपनी सेवा को बेहतर बनाने और अनुकूलित (कस्टमाइज़) करने के लिए करते हैं। सूचनाओं को कंपनी के सर्वर और/या सेवा प्रदाता के सर्वर पर अपलोड किया जा सकता है या इसे केवल आपके डिवाइस पर संग्रहित किया जा सकता है।

• ऐसी सूचनाएं जो हमें आपको प्रभावशाली सेवाएं प्रदान करने में सक्षम बनाती हैं। इन सूचनाओं में आपकी गैलरी तक पहुंच और आपके द्वारा हमें प्रदान की जाने वाली अन्य अनुमतियों के माध्यम से प्राप्त जानकारी शामिल है।

आप अपने उपकरण (डिवाइस) की सेटिंग्स या एप्लिकेशन की सेटिंग्स के माध्यम से किसी भी समय इन सूचनाओं तक पहुंच को सक्षम (इनेबल) या अक्षम (डिसेबल) कर सकते हैं

आपके निजी डेटा का उपयोग

आपके निजी डेटा का उपयोग कंपनी निम्नलिखित उद्देश्यों के लिए कर सकती हैः 

• अपनी सेवा प्रदान करने और उसे बनाए रखने के लिए, प्रदान की जाने वाली सेवा के उपयोग की निगरानी करना शामिल है।
• आपके खाते का प्रबंधन (मैनेज) करने के लिए: सेवा के उपयोगकर्ता के रूप में आपके पंजीकरण (रजिस्ट्रेशन) का प्रबंधन करने के लिए। आपके द्वारा प्रदान किया जाना वाला निजी डेटा आपको एक पंजीकृत उपयोगकर्ता के रूप में आपके लिए उपलब्ध सेवा की विभिन्न कार्यात्मकताओं (फंक्शनैलिटीज़) और सुविधाओं (फीचर्स) तक पहुँच प्रदान कर सकता है।
• आपसे संपर्क करने के लिए: मोबाइल एप्लिकेशन के नवीनीकरण (अपडेट्स) या कार्यात्मकताओं (फंक्शनैलिटीज़), लॉग-इन, उत्पादों या सुरक्षा नवीनीकरण (सिक्युरिटी अपडेट्स) से युक्त जानकारियों वाली अनुबंधित सेवाओं (कॉंट्रैक्टेड सर्विसेज़), और उनके कार्यान्वयन (इम्पलिमेंटेशन) के बारे में जब आवश्यक या उचित हो, ईमेल, टेलीफोन कॉल, एसएमएस या इलेक्ट्रॉनिक संचार के अन्य तरीकों जैसे कि पुश नोटिफिकेशन आदि के माध्यम से सूचनात्मक संचार (इंफॉर्मेटिव कम्युनिकेशन) के लिए।
• आपको समाचार, विशेष प्रस्तावों (स्पेशल ऑफर्स) और अन्य वस्तुओं, तथा हमारे द्वारा प्रदान की जाने वाली उन सेवाओं व कार्यक्रमों, जिन्हें आप पहले ही खरीद चुके होंगे या जिनके बारे में पूछताछ की होगी,  के बारे में सामान्य जानकारी तबतक प्रदान करने के लिए जब तक कि आपने ऐसी जानकारी प्राप्त न करने का विकल्प नहीं चुना हो।
• आपके अनुरोधों (रिक्वेस्ट्स) के प्रबंधन (मैनेज) करने के लिए: हमसे किए गए आपके अनुरोधों का ध्यान रखने (अटेंड) और उनका प्रबंधन करने के लिए।
• व्यावसायिक हस्तांतरण (बिजनेस ट्रांसफर) के लिए: हम आपकी सूचनाओं का उपयोग मूल्यांकन (इवैल्युएट) करने, विलय (मर्जर), विनिवेश (डिवेस्टिचर) , पुनर्गठन (रिस्ट्रक्चरिंग), पुनर्व्यवस्था (रिऑर्गनाइज) या विघटन (डिस्सॉल्युशन) करने, अथवा अन्य प्रकार की बिक्री या हमारी कुछ या सभी संपत्तियों का हस्तांतरण करने, चाहे जारी किसी चिंता (कंसर्न) या दिवालियापन (बैंक्रप्सी) के हिस्से के रूप में, परिशोधन (लिक्विडेशन) या इसी तरह की किसी अन्य कार्यवाही के रूप में, जिसमें हमारी सेवा का उपयोग करने वालों के निजी डेटा जो हमारे पास मौजूद होता है, हस्तांतरित होने वाली संपत्तियों में शामिल होता है।
• विवाद: विवादों को हल करने या समस्याओं का निवारण (ट्रबलशूट) करने के लिए।
• कानून को लागू (एन्फोर्स) करने और उसका पालन (कॉम्प्लाइ) करने में, जिसमें कि जांच करने का कार्य शामिल है, हमारे या किसी तीसरे पक्ष के अधिकारों की रक्षा करने के लिए, जन सामान्य या किसी एक व्यक्ति की सुरक्षा (सेफ्टी) की हिफाज़त (प्रोटेक्ट) करने में, या किसी गतिविधि का प्रतिकार (प्रिवेंट) करने या रोकने के लिए हम अवैध, धोखाधड़ी, अनैतिक या कानूनी रूप से कार्रवाई योग्य गतिविधि होने या होने का जोखिम उठाने पर विचार कर सकते हैं। 
• हमारी सेवा का संचालन (गवर्निंग) करने वाली शर्तों को लागू (एन्फोर्स) करने के लिए।
• अन्य उद्देश्यों के लिए: हम आपकी सूचनाओं का उपयोग अन्य उद्देश्यों के लिए कर सकते हैं, जैसे डेटा विश्लेषण (एनालिसिस), प्रयोग के रुझानों (ट्रेंड्स) की पहचान करना, हमारे प्रचार अभियानों की प्रभावशीलता का निर्धारण करना और हमारी सेवा, उत्पादों, सेवाओं, विपणन (मार्केटिंग) और आपके अनुभव का मूल्यांकन और सुधार करना।

हम निम्नलिखित परिस्थितियों में आपका निजी डेटा साझा कर सकते हैं:

• सेवा प्रदाताओं के साथ: आपके द्वारा हमारी सेवा के प्रयोग की निगरानी (मॉनिटर) और विश्लेषण करने, आपसे संपर्क करने और आपके द्वारा अनुरोध किए जाने पर बेहतर सहायता सुनिश्चित करने के लिए हम सेवा प्रदाताओं के साथ आपके निजी डेटा को साझा कर सकते हैं। 
• सहयोगी कंपनियों के साथ: हम आपके निजी डेटा को अपने सहयोगियों के साथ साझा कर सकते हैं, पर ऐसी स्थिति में उन सहयोगियों से गोपनीयता नीति का सम्मान करने की आवश्यकता होगी। सहयोगी कंपनियों में कोई भी साझेदार संगठन, दानकर्ता (डोनर्स) और/ या कोई अन्य सहायक (सब्सिडियरीज़), संयुक्त उद्यम भागीदार (ज्वाइंट वेंचर पार्टनर) या अन्य कंपनियां शामिल हैं जिन्हें हम नियंत्रित करते हैं या जो हमारे साथ सामान्य नियंत्रण में हैं। 
• व्यापारिक भागीदारों के साथ: हम आपको कुछ उत्पादों, सेवाओं, समर्थन (सपोर्ट) या प्रचार (प्रमोशन) की पेशकश (ऑफर) करने के लिए आपकी जानकारी को अपने व्यापारिक भागीदारों के साथ साझा कर सकते हैं।
• अन्य उपयोगकर्ताओं के साथ: जब आप व्यक्तिगत जानकारी साझा करते हैं या अन्य उपयोगकर्ताओं के साथ सार्वजनिक क्षेत्रों में बातचीत करते हैं, तो ऐसी जानकारी सभी उपयोगकर्ताओं द्वारा देखी जा सकती है और सार्वजनिक स्तर पर वितरित की जा सकती है।
• आपकी सहमति से: हम आपकी सहमति से किसी अन्य उद्देश्य के लिए आपकी व्यक्तिगत जानकारी का खुलासा कर सकते हैं।

आपके निजी डेटा को संभालकर(रिटेंशन) रखना

कंपनी आपके निजी डेटा को केवल तब तक संभालकर रखेगी जब तक कि इस गोपनीयता नीति में निर्धारित उद्देश्यों के लिए आवश्यक है। हम आपके निजी डेटा को अपने कानूनी दायित्वों (उदाहरण के लिए, यदि हमें मौजूदा कानूनों का पालन करने के लिए आपके डेटा को बनाए रखने की आवश्यकता है) का पालन करने, विवादों को हल करने, और अपने कानूनी समझौतों और नीतियों को लागू करने के लिए आवश्यक सीमा तक संभाल कर रखेंगे और उसका उपयोग करेंगे।

कंपनी आंतरिक विश्लेषण के उद्देश्यों (इंटरनल एनालिसिस परपज़) के लिए प्रयुक्त (यूसेज़) डेटा को भी संभाल कर रखेगी। प्रयुक्त (यूसेज़) डेटा को आम तौर पर कम समय के लिए रखा जाता है, सिवाय इसके कि इस डेटा का उपयोग सुरक्षा को मजबूत करने या हमारी सेवा की कार्यक्षमता में सुधार करने के लिए आवश्यक हो, या इस डेटा को लंबे समय तक बनाए रखने के लिए हम कानूनी रूप से बाध्य हों। 

आपके निजी डेटा का हस्तांतरण

आपकी सूचनाएं, निजी डेटा सहित, कंपनी के ऑपरेटिंग कार्यालयों में और किसी अन्य स्थान पर संसाधित (प्रोसेस्ड) की जाती है जहां प्रसंस्करण (प्रोसेसिंग)  में शामिल पार्टियां स्थित हैं। इसका मतलब यह है कि यह जानकारी आपके राज्य, प्रांत, देश या अन्य सरकारी क्षेत्राधिकार के बाहर स्थित कंप्यूटरों में  जहां डेटा सुरक्षा कानून आपके अधिकार क्षेत्र से भिन्न हो सकते हैं, स्थानांतरित की जा सकती है - और वहीं पर रखी रह सकती है।

इस गोपनीयता नीति के लिए आपकी सहमति के बाद आपके द्वारा ऐसी जानकारी उपलब्ध कराना, उस हस्तांतरण के लिए आपकी सहमति का प्रतिनिधित्व करता है।

आपका डेटा सुरक्षित रहे और डेटा संरक्षण (डेटा प्रोटेक्शन) कानून द्वारा स्वीकृत गोपनीयता नीति के हिसाब से उपचारित (ट्रीट) हो, यह सुनिश्चित करने के लिए कंपनी उचित रूप से आवश्यक सभी कदम उठाएगी। आपके निजी डेटा को तब तक किसी संगठन या देश को हस्तांतरित नहीं किया जाएगा जब तक कि हमारे द्वारा यह अवलोकन नहीं कर लिया जाता कि वहां की गोपनीयता नीति और वहां लागू होने वाला कानून कम से कम यहां के कानून के समान या यहां से उच्च स्तर का डेटा सुरक्षा उपाय करता है। 

आपके निजी डेटा का प्रकटीकरण (डिस्क्लोज़र)

1. व्यापारिक लेनदेन/ हस्तांतरण

यदि कंपनी किसी प्रकार के विलय, अधिग्रहण या संपत्ति की बिक्री में शामिल है, तो आपके निजी डेटा को हस्तांतरित (ट्रांसफर) किया जा सकता है। आपके व्यक्तिगत डेटा को हस्तांतरित करने और गोपनीयता नीति में बदलाव होने की दशा में हम आपको पहले नोटिस प्रदान करेंगे।

2. कानून का प्रवर्तन (लॉ एन्फोर्समेंट) 

यह नीति कानूनी सिद्धांतों के टकराव की परवाह किए बिना, नई दिल्ली, भारत के कानूनों द्वारा शासित है। इस नीति के तहत या इसके बाहर उत्पन्न होने वाले किसी भी दावे के लिए अधिकार क्षेत्र विशेष रूप से नई दिल्ली, भारत में राज्य अदालतों (स्टेट कोर्ट्स) के पास होगा। यदि इस नीति का कोई प्रावधान सक्षम क्षेत्राधिकार वाले न्यायालय द्वारा अमान्य पाया जाता है, तो ऐसे प्रावधान की अमान्यता इस नीति के शेष प्रावधानों की वैधता को प्रभावित नहीं करेगी, जो पूरी तरह से लागू और प्रभावी रहेगी। किसी भी परिस्थिति में इस नीति के उल्लंघन से उत्पन्न होने वाले किसी भी परिणामी (कॉन्सिक्वेंसियल), आकस्मिक (इंसिडेंटल), अप्रत्यक्ष या विशेष नुकसान (स्पेशल डैमेज) के लिए कंपनी का कोई उत्तरदायित्व नहीं होगा, चाहे देयता (लाइबिलिटी) कितनी भी क्यों न हो।

साथ ही, कुछ निश्चित परिस्थितियों में, जैसे कि कानूनी तौर पर आवश्यकता पड़ने या सार्वजनिक प्राधिकरणों (जैसे अदालत या सरकारी एजेंसी) द्वारा मान्य अनुरोधों के जवाब में कंपनी को आपके निजी डेटा का प्रकटीकरण (डिस्क्लोज़) करने की आवश्यकता पड़ सकती है। 

3. अन्य कानूनी अर्हताएं (रिक्वायर्मेंट)

निम्नलिखित कार्रवाईयों के आवश्यक होने की दशा में  कंपनी आपके व्यक्तिगत डेटा को नेकनीयती (गुड फेथ) के साथ प्रकट कर सकती है:

• कानूनी दायित्व का पालन करने के लिए
• कंपनी के अधिकारों या संपत्ति की रक्षा और बचाव करने के लिए
• सेवा के संबंध में संभावित ग़लत कार्यों को रोकने या जाँच करने के लिए
• सेवा का उपयोग करने वालों या जनता की व्यक्तिगत सुरक्षा के संरक्षण के लिए 
• कानूनी दायित्वों के संरक्षण के लिए 

आपके अधिकार

आपका निजी डेटा जो हम एकत्रित और संग्रहित करते हैं उस संबंध में आपके पास निम्नलिखित अधिकार होंगे, और आप हमें लिखित में देकर इन अधिकारों का प्रयोग कर सकते हैं।

• पुष्टिकरण (कन्फर्मेशन): क्या हमारे द्वारा आपका निजी डेटा संसाधित (प्रोसेसिंग) किया जा रहा है, इस बात की पुष्टि करने के लिए आप हमसे पूछ सकते हैं  
• पुनरावलोकन: आप हमारे पास संग्रहित अपने निजी डेटा की प्रति की मांग कर सकते हैं 
• सुधार: आप हमें अपने निजी डेटा में हुए किसी भी बदलाव के बारे में सूचित कर सकते हैं, और हमारे पास मौजूद आपके निजी डेटा की किसी भी अशुद्धि (एरोनियस) या गलती को सुधारने का आग्रह कर सकते हैं। आपके द्वारा हमें प्रदान किए गए डेटा की प्रामाणिकता के लिए हम ज़िम्मेदार नहीं हैं। आपके द्वारा हमें उपलब्ध कराए गए अपने निजी डेटा में किसी भी परिवर्तन की सूचना हमसे संपर्क कर बिना कोई देरी किए प्रदान करना सुनिश्चित करें। 
• प्रसंस्करण (प्रोसेसिंग) पर रोक: आप हमसे बात कर अपने निजी डेटा को मिटाने (ईरेज़), अपने निजी डेटा के प्रसंस्करण (प्रोसेसिंग) को बंद (ब्लॉक) करने या रोकने (रिस्ट्रिक्ट) के लिए कह सकते हैं, या हमारे द्वारा आपके निजी डेटा के किसी खास तरीके से किए जाने वाले प्रयोग के बारे में आपत्ति जता सकते हैं।
